What are 'Defenses'?
The legal arguments the employer uses to fight your claims.
In addition to admitting or denying the facts in the Complaint, the employer's Answer will also list their "defenses." These are the legal arguments they plan to use to argue that they should win the case, even if some of our factual allegations are true.
For example, a common defense in a discrimination case is that the employer's action (like a termination) was based on a legitimate, non-discriminatory reason, such as poor performance.
