What is 'Evidence'?
The information used to prove or disprove facts in your case.
Evidence is any kind of proof presented to support a legal claim or argument. It is the raw material both sides use to build their cases.
Why it matters to you
Cases are won with evidence, not just with a compelling story. Evidence comes in several forms:
- Testimony: Sworn statements from witnesses, whether at a deposition, in interrogatory answers, in an affidavit or declaration, or at trial.
- Documents: Emails, contracts, performance reviews, text messages, pay records, and other written materials.
- Physical objects: Any tangible item relevant to the case.
Your role is simple but important. Keep everything that might relate to your case, even items that seem minor or unflattering, and never delete or alter anything. Only gather materials you already have or can access through your own accounts, and send them to us so we can evaluate them.
An example from an employment case
In an unpaid overtime case, the strongest evidence might be badge-swipe records showing when you actually left work, texts from your supervisor asking you to finish reports at home, and your own sworn testimony about your typical week.
