What is a 'Deposition'?
A simple definition of a key step in the discovery process.
A deposition is a formal judicial proceeding where you, as a witness, give sworn testimony in a question-and-answer session. Although it does not take place in a courtroom, the testimony you give is every bit as important as live testimony at trial.
During the deposition, you will be asked questions by the opposing attorney while under oath. Your attorney will be present with you at all times, and a court reporter will record everything that is said. This testimony becomes part of the official record of the case and can be used in court.
The deposition is a critical step in your case, and thorough preparation is the key to success. We have created a comprehensive guide to help you understand the rules and feel confident and ready.
