What is 'Summary Judgment'?

A request for a judge to decide a case without a full trial.

A "summary judgment motion" is a specific type of motion, typically filed by the employer, asking the court to dismiss some or all of your claims. The employer argues that there are no significant facts in dispute and that they are entitled to win as a matter of law.

We will file a detailed written response opposing their motion. The judge will then review the arguments and evidence from both sides and make a ruling, a process that can often take 90 days or more.
